MARCØ — Terms of Service

This is a courtesy English translation provided for convenience. In case of any conflict or discrepancy, the Italian version (Termini di Servizio) prevails.

1. Acceptance

By using MARCØ you accept these Terms. If you do not accept them, you may not use the Service.

2. The Service

MARCØ is a SaaS platform providing AI-powered tools for digital marketing: research, brand identity, website, SEO, content, social posting, analytics. See /pricing for tier details.

3. Account and eligibility

• You must be ≥18 years old with the legal capacity to enter into contracts
• One account per person/entity (except WL tenants managing sub-clients)
• You are responsible for keeping your credentials confidential

4. Pricing & Billing

Billing: monthly via Stripe, automatic renewal. Cancellation: anytime from /settings/billing. The Service remains active until the end of the period already paid.

Trial: 14 days free for Starter/Growth (no card required). Agency/WL via manual demo only.

Refunds: full refund within the first 7 days, no questions asked. After that: pro-rata if requested within 30 days with a valid reason.

5. Acceptable use

You may NOT use MARCØ for:

• Illegal, defamatory, spam, or deceptive content
• Violating third-party rights (copyright, trademark, privacy)
• Generating content for prohibited industries (illegal gambling, weapons, illegal drugs)
• Circumventing tier limits (multi-account abuse)
• Reverse engineering or unauthorized access

Violations → immediate suspension + termination.

6. Intellectual property

6.1 MARCØ

Code, prompts, LangGraph graphs, overlay agents, knowledge base, the MARCØ brand → our property.

6.2 Generated content

You own the content generated for your business (brand kits, sites, posts). MARCØ holds a non-exclusive license to:

• Host + serve the content
• Use anonymized aggregates to improve the model (only with federated telemetry opt-in)

We never claim ownership of your output.

6.3 LLM output

LLM-generated content may not be copyright-protectable in some jurisdictions. We do not guarantee unique originality versus other AI outputs. For critical use cases, seek legal review.

7. Service availability

• SLA target: 99.5% monthly uptime (Starter/Growth) / 99.9% (Agency/WL)
• Scheduled maintenance: 48h+ notice via email
• Outages: reports and update requests to [email protected]
• Credits: if the SLA is not met → pro-rata monthly credit (request via support within 30 days)

8. White-Label

The WL tier (€299) allows you to:

• Brand MARCØ with your own logo/palette/custom domain
• Onboard sub-clients
• Apply a markup (e.g. charge your sub-clients €60 for the €29 base Starter)

WL = processor of sub-client data (auto-generated DPA as annex). MARCØ = sub-processor of the WL.

A 24h license heartbeat is mandatory. Missed heartbeat >48h → gradual soft suspension.

9. Termination

By you

Cancel anytime from /settings/billing. Service active until the end of the paid period. Data retained for 30 days post-cancellation (recovery), then hard-deleted.

By us

We may terminate with 30 days' notice for:

• Violation of the Terms (immediate in serious cases)
• Product discontinuation (unlikely; 6 months' notice in any case)
• Non-payment (14 days' notice)

If we terminate: pro-rata refund + free data export.

10. Disclaimer & limitations

• THE SERVICE IS PROVIDED "AS IS". MARCØ does not warrant that it will meet all your needs, be always available, error-free, or produce specific results.
• LLM output: AI-generated, may contain errors, bias, hallucinations. You are responsible for reviewing it before publication.
• Limitation of liability: MARCØ's total liability is limited to the amount paid in the last 12 months (except for willful misconduct/gross negligence or personal injury, where the law does not allow such limitation).

11. Indemnification

You indemnify MARCØ against third-party claims arising from:

• Your use of the Service in violation of these Terms
• Your published content violating laws or third-party rights
• Misuse of an account compromised through your negligence

12. Changes to the Terms

Email notice + UI banner 30 days in advance. By continuing to use the Service after the change you accept the new Terms. If you do not accept, you may cancel with a pro-rata refund for the unused period.

13. Governing law & jurisdiction

Italian law. Competent court: Milan. For consumers (B2C), the consumer's local court also applies where different.

EU consumers: you have access to the ODR platform (https://ec.europa.eu/consumers/odr).
